Does Riverside's Six-Month Claim Deadline Cover My Damaged Property Too?

Personal property, yes; real property, no. Government Code section 911.2 sets six months from accrual for a claim relating to death, injury to person, or injury to personal property, and one year for any other cause of action. The City of Riverside states the same split on its claims page, citing section 911.2 alongside Riverside Municipal Code chapter 1.05: six months for death, personal injury and personal property, one year for real property and money owed. Government Code section 915 governs delivery. Hand the claim to the clerk, secretary or auditor, mail it to one of them or to the governing body at its principal office, or submit it electronically where an ordinance or resolution expressly authorizes that. Riverside's City Clerk's Office sits at 3900 Main Street and the City Attorney's Office handles what the Clerk takes in.

The Driver Who Hit Me in Riverside Carried No Insurance, Where Does That Leave Me?

With your own policy, and with a deadline most people never hear about. Insurance Code section 11580.2 requires bodily injury liability policies issued in California to include uninsured motorist coverage unless the named insured deleted it in writing. Subdivision (p) folds in the underinsured driver: a vehicle insured for less than the uninsured motorist limits on your own car, with that coverage available only once the at-fault driver's liability limits have been exhausted by payment and proof is given to your insurer. The deadline is in subdivision (i). No cause of action accrues unless, within two years of the crash, you have sued the uninsured motorist, agreed the amount due, or formally started arbitration by written notice to the insurer sent certified mail, return receipt requested. Suit against the driver is filed in the Superior Court of California, County of Riverside.

A Neighbor's Dog Bit Me in Riverside, Does the Dog's History Matter?

For the owner's liability, no. Civil Code section 3342 makes the owner of any dog liable for damages suffered by a person bitten in a public place, or lawfully in a private place including the owner's own property, regardless of the dog's former viciousness or the owner's knowledge of it. Lawfully present covers someone there on a duty imposed by state law or United States postal regulations, or on the owner's express or implied invitation. Police dogs are treated differently. The section does not authorize a claim against a government agency whose dog bit while defending itself or assisting an apprehension, investigation, warrant or officer's defense, and that shield applies only where the agency has adopted a written policy on using dogs that way. Suit goes to the Superior Court of California, County of Riverside.

What Must a Driver Do Before Leaving a Crash Scene in Riverside?

Where anyone is hurt, Vehicle Code section 20001 requires the driver to stop immediately at the scene and then do what sections 20003 and 20004 say. Section 20003 means handing over your name, current address, vehicle registration number and the owner's name and address to the person struck or the other driver, and to any officer there, plus rendering reasonable assistance, including arranging transport to a doctor or hospital where treatment is obviously needed. For damage only, section 20002 lets a driver move to the nearest spot that will not block traffic, then either find the property owner or leave a written notice and tell the city police department without unnecessary delay. Where someone has died and no officer is present, section 20004 requires a report to the nearest California Highway Patrol or police office.

What Has to Be in a Contingency Fee Agreement Before a Riverside Client Signs?

Business and Professions Code section 6147 lists the terms, and the attorney has to hand you a duplicate copy signed by both of you at the moment the contract is made. The agreement must be in writing and must state the contingency fee rate you agreed on; how disbursements and costs incurred in pursuing or settling the claim affect both the fee and your recovery; the extent, if any, to which you could owe the attorney for related matters outside the contract; and, unless the claim falls under section 6146, that the fee is not set by law and is negotiable. Leave any of that out and subdivision (b) makes the agreement voidable at your option, with the attorney left to a reasonable fee. Read it in the meeting. Section 6147 is statewide, so the same list applies to any California firm you sit down with in Riverside.

Once a Complaint Is Filed in Riverside, How Long Can It Sit Unserved?

Three years, and the court counts from filing. Code of Civil Procedure section 583.210 requires the summons and complaint to be served on a defendant within three years after the action is commenced against that defendant, and the section states that the action commences when the complaint is filed. Subdivision (b) adds a second date: proof of service of the summons has to be filed within 60 days after the service deadline. Neither one is a target to aim for. A defendant served close to the limit has had years to lose records, change insurers and forget details. Unlimited civil cases from Riverside ZIP codes 92501 through 92522 are filed at the Riverside Historic Courthouse, 4050 Main Street, under the court's administrative order on where to file civil documents.

How Do I Show the Other Driver Was Going Too Fast on a Riverside Street?

Through the physical evidence, because Vehicle Code section 22350 is not about the posted sign. It bars any speed greater than is reasonable or prudent given the weather, the visibility, the traffic, and the surface and width of the road, and any speed that endangers people or property. Skid marks, crush damage, signal timing and the officer's narrative are what make that case. Evidence Code section 669 is the payoff: a driver who broke section 22350 and caused the kind of injury it exists to prevent is presumed to have failed to exercise due care, subject to rebuttal. Riverside Police Department collision reports are usually ready about 10 working days after the incident, though fatal collisions and those involving on-duty emergency vehicles are released by the department only.

What Changes if the Vehicle Belonged to Riverside County Rather Than the City?

The address you file at, and that detail decides cases. Government Code section 905 requires all claims for money or damages against local public entities to be presented under the claims statutes, with listed exceptions such as claims where workers' compensation is the exclusive remedy. Government Code section 911.2 keeps the six-month deadline for injury to person or personal property. Government Code section 915 says the claim goes to that entity's own clerk, secretary or auditor, or to its governing body at its principal office. A claim against the County of Riverside does not belong at the City Clerk's counter on Main Street, and a Riverside Transit Agency bus claim belongs with RTA, a joint powers agency and a public entity in its own right. Identify the owner before the six months run.

Can Interest Be Added to a Judgment Against the City of Riverside?

Not under the usual rule, and that surprises people. Civil Code section 3291 normally rewards a plaintiff who makes a realistic offer: serve an offer under Code of Civil Procedure section 998, have the defendant let it lapse before trial or within 30 days, then beat it at trial, and the judgment carries interest at the legal rate of 10 percent per year running from that first offer until the judgment is satisfied. The final paragraph of section 3291 takes public entities out of it. The section does not apply to a public entity, or to a public employee for an act or omission within the scope of employment, and neither can be held liable for that interest. Riverside owns its own utility, so a claim over a pole or a water main lands on that side of the line.

I Already Settled the Car Repair After a Riverside Crash, Is My Injury Claim Still Alive?

Those are two claims on two clocks. Code of Civil Procedure section 338, subdivision (c), covers an action for taking, detaining or injuring goods or chattels and allows three years, which is the heading the damaged vehicle falls under. Injury to a person is shorter: section 335.1 allows two years for an action for injury to, or the death of, an individual caused by another's wrongful act or neglect. Taking a repair payment does not move either date. What it can do is bind you, depending on the wording of whatever you signed, so dig out the release and the check stub before you assume anything. Where a public entity is a defendant, Government Code section 911.2 puts a six-month claim deadline in front of both. Either way, the suit is filed at the Riverside Historic Courthouse on Main Street.
