Don’t Let Insurance Companies Control Your Outcome

After an accident, insurance companies are already working against you. They offer low settlements, drag out your personal injury claim, and pressure you to sign away your rights.

At My Injury Pros, we step in to protect you. Our personal injury lawyers take on the insurance company so you are not pushed around or underpaid.

Insurance companies and other parties involved in your case, such as defense attorneys, may try to minimize your compensation.

Your Case Deserves a Strategy Built to Win

At My Injury Pros, we craft every personal injury case with strategy and urgency.  Whether your injuries stem from a motor vehicle accident, a motorcycle crash, or another serious incident, our lawyers build your case with a clear plan. We take control early to protect your position.

To prove negligence in a personal injury case, the plaintiff must establish liability. This includes showing a duty of care, a breach of that duty, and damages caused by the breach.

Proving liability requires gathering strong evidence, such as accident reports, medical records, witness statements, and photographs of the scene. The burden of proof lies with the plaintiff to establish their claims by a preponderance of the evidence. Identifying the parties responsible is crucial to securing the compensation you deserve.

How Our Personal Injury Law Firm Builds Stronger Cases:

We Investigate Every Detail
From crash reports, the police report, and medical records, we dig into what happened and identify who is responsible.

We Work With Proven Experts
Medical professionals, accident reconstruction specialists, and financial experts support your claim with solid evidence.

We Focus on Full Compensation
Our goal is to recover everything you are entitled to, including medical bills, lost income, pain and suffering, and long-term care.

We Prepare for Trial from the Start
If the insurance company refuses to settle fairly, we are fully prepared to take your case to court.

This approach is based on proven strategies with a clear purpose and a record of results.

Why Waiting Can Cost You After an Injury

When you are injured in an accident, time is not on your side. While you try to recover, insurance companies are already working to limit what they pay you. The longer you wait to take legal action, the harder it becomes to build a strong personal injury claim. Delays lead to lost evidence, missed deadlines, and pressure to accept unfair settlements.

Under California's pure comparative negligence statute, your damages may be reduced in proportion to your share of liability in the accident.

At My Injury Pros, we take action immediately. We investigate your case, protect your rights, and put pressure on the other side before they can take advantage of the delay.

California law generally allows two years to file a personal injury claim, but in some cases, such as claims involving government entities, shorter deadlines may apply.

Why Acting Now Matters

Evidence Fades Quickly

Photos, witness statements, and accident reports lose their strength with time. Waiting makes it harder to prove your case.

Insurers Move First

They act fast to protect their bottom line. We step in early to protect yours.

Delays Create Financial Stress

Unpaid medical bills, lost wages, and recovery costs can pile up. We work to recover every dollar.

Missing Legal Deadlines Ends Cases

California has strict time limits for filing personal injury cases. Miss the window, and you lose your right to compensation.

Waiting gives them the advantage. Taking action gives you a path forward. Let’s take the next step together.

Considering Whether to Hire a Personal Injury Lawyer

Not every accident requires legal representation. In some cases, individuals with very minor injuries and clear liability may choose to handle a claim directly with the insurance company, especially when medical treatment is limited and damages are minimal.

However, handling a personal injury claim without legal guidance can involve risks. Insurance companies often aim to limit payouts, and once a settlement is accepted, you typically give up the right to seek additional compensation later. Legal representation may also involve longer timelines if litigation becomes necessary, and attorney fees apply if compensation is recovered. Speaking with a personal injury lawyer during a free consultation can help you understand these trade-offs and decide which approach makes the most sense for your situation.

Frequently Asked Questions

It’s important to understand that hiring a personal injury lawyer is not always necessary in every situation. In cases involving minor injuries and clear liability, some individuals choose to handle claims directly with the insurance company. Legal representation may involve longer timelines if litigation is required, and attorney fees apply if compensation is recovered. A consultation can help you weigh these considerations and decide what approach best fits your situation.

The information provided here is for general guidance only and does not replace legal advice. Results and legal options vary depending on the facts of each case.

Each driver has a reporting duty where the thresholds are met. Vehicle Code section 16000 requires the driver of a motor vehicle involved in an accident to report to the DMV office in Sacramento within 10 days where anyone suffered bodily injury or died, or where property damage to any one person exceeded $1,000. The report can go in personally or through an insurance agent, broker or legal representative, on a department-approved form, and it has to identify anyone who complained of injury. The police report is a separate errand. The Chula Vista Police Department releases copies through Police Support Services on Fourth Avenue, in person or by mail, and the report takes a couple of weeks to become available.
It pays a gap, not a second full policy. Under subdivision (p) of Insurance Code section 11580.2, a vehicle is underinsured when it carries less liability coverage than the uninsured motorist limits on your own car. The coverage does not apply at all until the liability limits of every vehicle that caused the injury have been exhausted by payment of judgments or settlements, with proof of that payment submitted to your insurer. Your carrier's ceiling is then your own limit less what has already been paid. Subdivision (q) blocks stacking two policies into a bigger pot. If you sue the at-fault driver, subdivision (p)(6) makes you hand your own insurer a copy of the complaint right away, by personal service or certified mail.
Either route exists. Code of Civil Procedure section 377.60 lets the listed survivors assert the claim, or lets the decedent's personal representative assert it on their behalf. The list is the surviving spouse, domestic partner, children and the issue of deceased children, with intestate heirs stepping in where no issue survives, plus the dependents named in subdivision (b). Section 377.61 has the court determine the respective rights of everyone entitled to the award, which is the practical argument for one coordinated case instead of several competing ones. Filing happens downtown rather than locally: the San Diego Superior Court routes civil cases from the South and East areas to the Central Division at 330 West Broadway, not to the South County Division courthouse on Third Avenue.
Business and Professions Code section 6147 sets the floor. The contract is in writing, signed by both the attorney and the client, and you receive a duplicate signed copy at the time it is entered into, not weeks afterwards. It has to state the contingency fee rate agreed, how disbursements and costs incurred will affect both the fee and your recovery, and the extent to which you could be required to pay for related matters outside the contract. Unless the claim falls under section 6146, it also has to say the fee is not set by law and is negotiable. Missing any of that makes the agreement voidable at your option, and the attorney is then limited to a reasonable fee. In a Chula Vista case the costs line is real: report copies, downtown filing, service, depositions.
Vehicle Code section 21453 is precise about where a driver stops. Facing a steady circular red, the driver stops at the marked limit line; if there is none, before the crosswalk on the near side; if there is none, before entering the intersection, and stays stopped until an indication to proceed shows. A right turn on red, or a left from a one-way street onto a one-way street, is allowed after that stop, but only while yielding to pedestrians lawfully in the adjacent crosswalk and to any vehicle close enough to be an immediate hazard. A steady red arrow allows no such turn. Evidence Code section 669 presumes a lack of due care from a proved violation that caused the injury. Chula Vista's Local Road Safety Plan draws on five years of collision data.
Government Code section 946.6 names them. After a late-claim application to the board is denied or deemed denied, the court grants relief from section 945.4 where the application was made within a reasonable time and one of these fits: the claim was late through mistake, inadvertence, surprise or excusable neglect, with no prejudice shown to the entity's defense; the injured person was a minor throughout the period; the person was physically or mentally incapacitated throughout it and missed the deadline for that reason; or the person died before the six months in section 911.2 ran out. Claims here go to the Office of the City Clerk at 276 Fourth Avenue, in person, by mail or online, and the City Attorney's Office processes them.
Interest, at a rate the statute fixes. Civil Code section 3291 lets a plaintiff in a personal injury action claim interest on the damages alleged. Serve an offer under Code of Civil Procedure section 998, have the defendant let it lapse before trial or within 30 days, whichever comes first, then obtain a judgment more favorable than that offer, and the judgment bears interest at 10 percent a year from the date of the first offer the judgment exceeded, running until the judgment is satisfied. Section 998 can also shift the defendant's postoffer expert witness costs at the court's discretion. One carve-out matters locally: section 3291 does not reach a public entity or a public employee acting in the scope of employment, so an offer to the City of Chula Vista carries no such interest.
Start with ownership. Government Code section 830 defines public property as real or personal property owned or controlled by the public entity, and it excludes easements and encroachments sitting on the entity's land without being owned or controlled by it. A trail can cross city land, district land or a private easement within a single mile, so pin down the owner before writing anything. Then section 835 asks whether the property was in a dangerous condition, whether that condition proximately caused the injury, whether the risk of that kind of injury was reasonably foreseeable, and whether an employee created the condition or the entity had notice. Section 830 also keeps minor and trivial defects out. Against the City of Chula Vista, the written claim goes in within the six months set by section 911.2.
The employer can be, and Civil Code section 2338 is the reason. A principal is responsible to third persons for the negligence of an agent in transacting the business of the agency, including wrongful acts committed as part of that business. So the question is not who owns the van. It is what the driver was doing at that moment: a delivery on the route, or a personal errand off it. Civil Code section 1714 supplies the underlying duty of ordinary care the driver breached. Dispatch records, route assignments and vehicle telematics answer the business question better than the driver's recollection does. Ask for them in writing early, before a retention schedule clears them, and pull the Chula Vista Police Department report in the meantime.
A heavier burden of proof and a particular kind of conduct. Civil Code section 3294 allows damages for the sake of example and by way of punishing the defendant only where oppression, fraud or malice is proved by clear and convincing evidence, which is a steeper standard than the one governing the rest of the case. Malice means conduct intended to injure, or despicable conduct carried on with a willful and conscious disregard of the rights or safety of others. Oppression means despicable conduct subjecting a person to cruel and unjust hardship in conscious disregard of their rights. Against a company, subdivision (b) needs advance knowledge of an unfit employee, or authorization or ratification by an officer, director or managing agent. Ordinary carelessness does not reach it.
