Frequently Asked Questions

New Jersey law allows victims two years from the date of injury to file a personal injury claim.
In New Jersey, there is no cap on pain and suffering damages in personal injury cases, but juries and judges consider factors like severity, impact on quality of life, and medical evidence when awarding compensation.
Personal injury cases in New Jersey generally settle within six months to two years, though more complex cases requiring litigation can take longer.
Hiring a personal injury lawyer typically costs nothing upfront, as most attorneys, including My Injury Pros, work on a contingency fee basis, meaning they only get paid if you win. The standard fee is 33% to 40% of the settlement.
It is the deadline that ends more New Jersey claims than any other. Under N.J.S.A. 59:8-8, a claim for death, or for injury or damage to person or property, has to be presented to the public entity no later than the 90th day after the cause of action accrues. N.J.S.A. 59:8-3 makes that notice a precondition to suing a public entity or a public employee at all. After the notice is received there is a six-month wait before suit can be filed, and the outside bar is two years from accrual. So a claim against a township, a county, a school board or NJ Transit runs on a much shorter clock than a claim against a private driver.
Sometimes, and the route is narrow. N.J.S.A. 59:8-9 lets a claimant apply to the court for leave to file a late notice of claim, but only within one year after the cause of action accrued, and only on a showing of sufficient reasons constituting extraordinary circumstances for the failure to file within the 90 days. The public entity also has to be substantially unprejudiced by the delay. Two things follow. Past one year there is no application to make, whatever the reason. And inside the year, an ordinary oversight is not an extraordinary circumstance, so the application is an argument to be built with evidence rather than a form to be filed.
It decides whether pain and suffering is on the table. N.J.S.A. 39:6A-8 makes every named insured who must carry personal injury protection choose between two tort options. Pick the limitation on lawsuit option, often called the verbal threshold, and you are exempted from suing for noneconomic loss unless the injury falls into one of the categories the statute lists, among them death, dismemberment, significant disfigurement or significant scarring, displaced fractures, loss of a fetus, and a permanent injury within a reasonable degree of medical probability. Pick the no limitation on lawsuit option and that restriction does not apply. Economic losses are recoverable either way. Check the declarations page before assuming which one applies.
More people than most drivers realise. N.J.S.A. 39:6A-4 requires every standard automobile liability policy to carry personal injury protection benefits payable without regard to negligence, liability or fault of any kind. The coverage reaches the named insured and family members living in the household who are hurt while occupying, entering, leaving or using a car, and it reaches them as pedestrians struck by a car or by an object thrown from one. It also reaches other people hurt while using the named insured's car with permission. Medical expense benefits are paid in accordance with the benefit plan written into the policy and approved by the commissioner, so the limits turn on which plan was bought.
Two different thresholds, and they get confused constantly. On recovery, N.J.S.A. 2A:15-5.1 says contributory negligence is no bar as long as the plaintiff's negligence was not greater than the negligence of the defendant, or of the defendants combined. A plaintiff at exactly 50 percent still recovers, with damages reduced by that percentage. On collection, N.J.S.A. 2A:15-5.3 draws its line at 60. A defendant found 60 percent or more responsible can be made to pay the full amount of the damages. A defendant below 60 percent pays only the percentage directly attributable to its own negligence or fault. The trier of fact fixes those percentages under N.J.S.A. 2A:15-5.2.
N.J.S.A. 39:4-130 sets two separate duties and people tend to remember only the first. A driver involved in an accident resulting in injury, in death, or in damage to the property of any one person over $500 must give notice by the quickest means of communication to the local police, the county police or the nearest State Police office. The same driver must then forward a written report to the commission within 10 days on its own forms. The written report is excused where a police officer who investigates the accident files a report under N.J.S.A. 39:4-131. Separately, N.J.S.A. 39:4-129 covers what to do at the scene, including stopping and exchanging information.
